• 3. Your status:
  3.1. By placing an order through the site, you warrant that:
  (a) You are legally capable of entering into binding contracts
  (b) You are purchasing the Products for your own personal and non-business use; unless otherwise explicitly agreed upon, following our communication
  3.2 Any personal data that we gather concerning you shall be used only in accordance with our “ Privacy Policy”

• 4. Execution of the contract:
  4.1 The price and essential characteristics of each Product are displayed on the site. Before submitting an order through the site, you shall carefully read all the instructions provided during the purchase procedure (also with regard to the right of withdrawal conditions and the methods to exercise it, the delivery charges and the Privacy Policy statement), along with these General Conditions of Sale.
  4.2 The Client acknowledges and agrees that the order may be canceled in case of
  i. the Products are not available
  ii. a reported, or suspected, fraudulent or illegal activities, including suspected purchases for commercial purposes; copyright infringement;
  iii. the Client has not fulfilled his/her obligations deriving from a prior contract
  4.3 Despite the Order Confirmation, in case of unavailability of one or more of the ordered Products, the Client will receive an e-mail duly informing him about the unavailability of the Products. In this case the order proposal will be canceled or partially accepted just in relation to the available Products. In case of partial acceptance, the Client shall pay (or shall be charged, in case of payment through the credit card) only the price of the available Products

• 5. Availability and product’s information:
  Information on Products (along with the relevant Product codes) and relevant prices are available on our site.

• 6. Transport and delivery:
  6.1 Your order will be fulfilled within a reasonable time of the date of the Order Confirmation, unless there are exceptional circumstances. The delivery date will vary based on the delivery address, type of Products and other relevant factors. Products shall be delivered to the address indicated by the Client in the order proposal.
  6.2 A shipping confirmation shall be sent to the Client via e-mail once the Products are dispatched (hereinafter “Shipping Confirmation”).
  6.3 At the time of delivery of the Products by the Courier, the Client (or a nominated representative) is required to verify:
  (a) that the addressee indicated on the delivery note is correct; and
  (b) that the packaging and its seals are intact, undamaged, not wet or altered in any manner.
  6.3 Any damages to the packaging and/or the Product(s), or discrepancies in the addressee references or documentation must be immediately indicated in writing to the Postal Service’s delivery note.

• 7. Customs and import taxes:
  Buyers are responsible for any customs and import taxes that may apply. The company is not responsible for delays due to customs.

• 8. Consumer rights Cancellations & Replacements: 
  8.1 Cancellation: In accordance with the Laws for Consumer rights you may cancel a contract for a Product within fourteen calendar days, beginning on the day after you received the relevant Products ( the Cancellation Period). In this case, you will receive a full refund of the price paid for the Products in accordance with the refunds policy (set out at clause 8 below). To cancel a contract, you must inform us within the Cancellation Period, by email at [email protected]
  8.2 Replacements are not available.

• 9. Refunds and Returns policy:
  9.1 If you would like to return a Product to us, please contact us at [email protected] in order to receive mailing instructions
  9.2. The refund would be charged to your account in full upon receipt of the products, in the same condition in which you received them by the company
  9.3 Products that are being used, may be partially refunded. Custom made products are not eligible for refunds.
  9.4 Buyer is responsible for return shipping costs
  9.5 Restrictions: Items that are custom made or tailor made or made to order following customer request (referred to in the website as “Custom or Made to Order items”) cannot be returned and are not refundable.

• 10. Events out of control:
  Our performance under any contract is deemed to be suspended for the period of occurrence of a Force Majeure Event, and we will have an extension of time for performance for the duration of that period. Every reasonable endeavor will be used to find a solution by which our obligations under the contract may be performed despite the Force Majeure Event.

• 11. Amendments and Revisions to the General Conditions of Sale:
  11.1 We have the right to revise and amend these General Conditions of Sale that you are subject to from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system’s capabilities.

• 12. Copyright and Trademark:
  12.1 All rights pertaining to the content on this site (text, images, video, voices, programs etc.) as well as to the products purchased belong to CHARIKLEIA FRAGKIADAKI (hereinafter referred to as the company or Eri Fragiadaki) with registered private company seat at 6 Sina Str, Heraklion Crete Greece– VAT number EL024880484, and company registration number 127880327000 (General Commercial Registry). None of the articles, photos, illustrations etc. on this site may be used without the prior permission.

• 13. Law and jurisdiction:
  13.1 These General Conditions of Sale and, therefore, the contracts executed with the Clients, are governed by and must be interpreted in accordance with the Greek legislation.
